Terms and Conditions

1. Scope

1.1. These Terms and Conditions (hereinafter referred to as "Terms") apply to all business relations between The Book Agency Verlag Schreiberlinge OG (hereinafter referred to as "we", "us", or "SAVAARA") and our customers (hereinafter referred to as "you" or "customer") regarding the purchase and sale of goods and services.

1.2. By placing an order with us, you agree to be bound by these Terms. Any terms or conditions provided by the customer which conflict with or deviate from these Terms shall not be recognized, unless we have expressly consented to their validity in writing.

Conclusion of Contract

2.1. The presentation of products or services on our website does not constitute a legally binding offer, but a non-binding online catalog. By placing an order, you make a binding offer to purchase the products or services in your shopping cart.

2.2. We will confirm receipt of your order via email. This confirmation does not constitute acceptance of your offer. A binding contract is only formed when we expressly accept your order by sending a separate order confirmation or by dispatching the goods.

3. Prices and Payment Terms

3.1. All prices listed on our website are in Euro and inclusive of VAT unless otherwise stated. Additional costs such as shipping charges will be indicated separately during the ordering process.

3.2. Payment can be made by the methods specified during the ordering process. Payment must be made in full without any deductions unless otherwise agreed in writing.

4. Delivery

4.1. Delivery times specified by us are approximate and non-binding unless a fixed delivery date has been agreed upon in writing.

4.2. We reserve the right to make partial deliveries unless you have expressly objected to this.

4.3. The risk of accidental loss or damage to the goods passes to you upon delivery.

5. Right of Withdrawal

5.1. Consumers have a legal right of withdrawal. Please refer to our separate cancellation policy for detailed information on your right of withdrawal.

6. Warranty

6.1. We warrant that the goods are free from defects in material and workmanship at the time of delivery.

6.2. Any claims for defects must be notified to us in writing without undue delay, specifying the nature of the defect.

6.3. Our liability for damages arising from injury to life, body, or health, as well as for other damages caused by intentional or grossly negligent breach of duty by us, our legal representatives, or agents, remains unaffected.

7. Liability

7.1. We shall only be liable for damages other than those resulting from injury to life, body, or health if they are caused by intentional or grossly negligent conduct on our part, our legal representatives, or agents.

7.2. Liability under the Product Liability Act remains unaffected.

8. Data Protection

8.1. We collect, process, and use personal data of our customers only in accordance with applicable data protection laws and our Privacy Policy.

9. Applicable Law and Jurisdiction

9.1. Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

9.2. If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship shall be the court having jurisdiction over our registered office.

10. Amendments to the Terms

10.1. We reserve the right to amend these Terms at any time. The version of the Terms applicable at the time of your order shall apply.

11. Severability Clause

11.1. If any provision of these Terms is or becomes invalid or unenforceable, this shall not affect the validity of the remaining provisions. In place of the invalid or unenforceable provision, a valid and enforceable provision shall apply that comes closest to the economic purpose pursued by the invalid or unenforceable provision.
